These general terms and conditions govern without restriction the sales of products on the website www.quycup.com.
ARTICLE 1. PURPOSE
1.1 These general terms and conditions of sale govern the rights and obligations of the parties resulting from the sale of products offered on the website www.quycup.com owned and managed by the company Lifestyle srl, Via Lorenzo il Magnifico N. 48, 50129 Firenze (Fi) Italy, P.iva 07000890488.
ARTICLE 2. CONTRACT PARTIES
2.1 The parts of the sales agreement are:
Seller: Lifestyle srl
Customer: the subject that purchases one or more products through the website www.quycup.com for personal purposes and non-trader individuals who operate for purposes which exclude any professional or commercial activity.
ARTICLE 3. ACCEPTANCE OF THE TERMS AND CONDITIONS
3.1 Any order of a product offered on the website implies the customer’s full acceptance of these general terms and conditions of sale. They constitute, with the validation and confirmation of the order, the contract concluded between Lifestyle srl and the customer.
3.2 Lifestyle srl reserves the right, in its sole discretion, to change the terms under which the website is offered. your use of this website after we post any changes to these terms constitutes your agreement to those changes. you agree to review these terms periodically to ensure that you are familiar with the most recent version. the general terms and conditions of sale applicable are those in force on the website on the date the order is placed.
3.3 Any order of a product offered on the website implies the customer’s full acceptance of these general terms and conditions of sale. They constitute, with the validation and confirmation of the order, the contract concluded between Lifestyle srl and the customer.
ARTICLE 4. DOCUMENTS
4.1 The customer may purchase any product presented as available and at the price indicated on the website on the day he places his order. The customer accepts that the order confirmation is considered as proof of the contract concluded with Lifestyle srl on its website.
4.2 Placing an order constitutes the customer acceptance of the prices and characteristics of the products purchased on the website, as well as of these terms and conditions. our acceptance of your order brings into existence a legally binding contract between us. The customers is entirely responsable to read and keep a copy of these conditions of sales.
ARTICLE 5. PRICES AND PRODUCTS
5.1 The product prices are indicated on the website in euro. The seller reserves the right to modify prices. the customer has to pay the full price agreed at payment time.
5.2 In european union prices includes value added tax and delivery costs.
Outside european union all the customs procedures and any possible adding costs (e.g. packagesstopped by customs) remain at the exclusive charge of the customer.
5.3 Promotions, promo codes, coupons are valid just if confirmed by the seller in order confirmation (see article 8).
5.4 Lifestyle srl has made every effort to display as accurately as possible the colors of the products that appear on www.quycup.com. However, as computer monitors vary, we cannot guarantee that your monitor’s display of any color will be completely accurate.
ARTICLE 6. DELIVERY OF THE ORDER
6.1 After placing the order, customer should choose payment method and indicate billing and shipping address. For orders placed in Italy from italians, fiscal code is required. For orders placed outside Italy from non-italians date and place of birth is required. Customers must be of legal age and have the legal capacity to conclude such a contract, otherwise it will not be valid.
ARTICLE 7. PAYMENT METHODS
7.1 Please note that occasional pricing and other errors may occur on the site. Lifestyle srl reserves the right to revise pricing, products and other errors and to cancel any order you have placed if there was an error concerning the price or availability of any item you ordered when you placed the order, even if you have received an order confirmation. If your credit card has already been charged for the purchase and your order is cancelled, Lifestyle srl will issue a credit to your credit card account in the amount of the charge. Your bank or credit card company policies will determine when this amount is credited to your account.
7.2 The seller accepts only the payment methods indicated on the website. other methods can be accepted only with prior consent of the seller (for further information send an email to email@example.com.
7.3 In case of payment with credit card or paypal, they are made via a secure platform accessible from Lifestyle srl only. There is no way the seller may know the credit card number. The payment made may not be cancelled. If you purchase any product on the website, you will need to provide certain information relating to your purchase, including without limitation your credit or debit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that you have the legal right to use any credit/debit card(s) utilized in connection with any transaction. You also grant us or the third vendor collecting that information on our behalf the right to provide such information to third parties for processing the transactions initiated by you or on your behalf. We may also need to conduct certain verification of information prior to processing any transaction.
7.4 Title to all products and risk of loss or damage is only transferred to the customer upon shipment from Lifestyle srl. It is customer responsibility to comply with all applicable local, state, federal, and foreign laws in regard to the possession, use and sale of any item purchased from the website.
7.5 By placing an order, you represent that the products ordered will be used only in a lawful manner.
ARTICLE 8. CONFIRMATION OF THE ORDER
8.1 Following the payment, a confirmation email summarizing the details of the order is sent to the customer, to the email address indicated at the transmission of his contact details.
8.2 If, no later than 24 hours following acceptance of the payment, the customer doesn’t inform the seller about changes or modifications, the details and data provided will be accepted and the order actually registered and considered definitive. In the event of the unavailability of a product, the seller will inform the customer as soon as possibile and by the way within 30 days after validation of the order and payment. In the above mentioned case, the seller will cancel the entire order and refund its amount to the customer, including taxes and delivery costs. Otherwise, prior authorization of the customer, the seller could deliver a product of an equivalent quality and price.
8.3 Lifestyle srl reserves the right not to validate the order on legitimate grounds and in particular in the event of:
Abnormal or abusive claims from the customer during his previous orders;
Abnormal or abusive exchanges and returns from the customer during his previous orders;
Existing dispute(s) with the customer; no goods in stock for any reason.
The seller will prepare the order in the next days from monday to friday from 11 a.m. to 4 pm italian time.
ARTICLE 9. DELIVERY OF THE ORDER
9.1 Shipping is free for orders over eur 100,00. While we attempt to ship all orders as soon as possible, most orders received after 2 p.m. will likely go out the following business days. We do ask that you allow up to 3 business days for orders to be fulfilled.
9.2 Lifestyle srl has chosen to partner with dhl and gls for most domestic shipment and with dhl for international ones. Products are delivered to the address indicated by the customer when he places his order on the website www.quycup.com.
9.3 In case of delays, damage, total or partial losses of products and/or of the order, it is the responsibility of the customer to exercise any remedy directly with the carrier and to inform lifestyle srl at the same time.
9.4 Lifestyle srl will make its best effort to ensure that the orders will be delivered in a period of 15 business days as of receipt of the customer’s payment. In any event, all products purchased will be delivered within a maximum period of 30 working days from the day following receipt of payment of the order.
9.5 Transport costs remains at the customer’s charge and may vary depending on countries.
9.6 Lifestyle srl may not be held responsible for delays in delivery due to errors attributable to carriers. Lifestyle srl may not remedy any defaults in execution of the carrier which it does not want to assume, but may possibly help the customer with the carrier.
9.7 The seller commits, however, to collect any failure or delayed delivery of products by means of the customer service dedicatedly dedicated and to help the customer to protect its rights as per law.
9.8 In case of failure to pick up the goods or failure to deliver for event not attributable to the seller, or to the courier, the shipping costs and return of the purchased products are borne by the customer.
ARTICLE 10. CUSTOMS, DUTIES & TAXES
10.1 When ordering on www.quycup.com, client / customer is responsible for assuring that the product can be lawfully imported to the destination. The recipient is the importer of record and must comply with all laws and regulations of the destination.
10.2 Orders shipped outside the EU may be subject to import taxes, customs duties and fees applied by the destination country. The recipient of an international shipment may be subject to import taxes, customs duties and fees, which are applied once a shipment reaches the recipient’s country. Addittional cherges for customs clearance must be fulfilled by the recipient.. Lifestyle srl has no control over these charges.
10.3 Customs Policies Vary Widely; You Should Contact Your Local Customs Office For More Information. When Customs Clearance Procedures Are Required, It Can Cause Delays Beyond Our Original Delivery Estimates.
ARTICLE 11. RECEPTION OF THE ORDER
11.1 The customer must verify the content and the condition of the products. He must check the condition of the products delivered before signing the acknowledgement of receipt of the package. If the customer finds any anomalies, he must refuse the delivery of the products. Any complaints regarding this shall be received within 24 hours from the receipt of the package under the decader. However, in the event of breakings and / or tampering of the package, the customer must absolutely refuse the goods. Once the courier’s document is signed, he will not be able to offer any disputes about the external characteristics of what has been delivered to him/her.
11.2 After 10 working days, claims are not accepted and the products will be considered checked and verified by the customer. Comply with the descriptions and / or models provided by the seller, equipped with the qualities and performances that the customer can reasonably expect from a product of that type and complete with all accessories, components or other products or elements made part of the product or with this product or with in all senses.
11.4 Worn parts, dams, scratches and scraped paint are not caused for replacement and will not be recognized as covered by the warranty, because they result from normal use in particular, as regards a default default , freezer or dishwasher, will make the warranty void.
11.5 As regards Quycup in baby fiber, general wear, including (but not limited to) the change of colors and materials over time, is not considered a manufacturing defect.
ARTICLE 12. ACKNOWLEDGEMENT OF RECEIPT
12.1 After the payment of the order the seller will prepare a receipt of payment. In order to prepare receipt of payment and invoice italian customers must indicate their fiscal code. Non-italians customer must indicate their date and place of birth.
ARTICLE 13. RIGHT OF WITHDRAWAL AND RETURNS
13.1 The customer is free to exercise return right by written communication sent to www.quycup.com within 10 working days, and sending back the product within 11 working days from reception of the order. After above mentioned written communication, the seller will send an email to the customer attaching a goods return form. The customer must stick it to the package or put into it. in the same form the customer will find the instructions to follow to return the goods.
13.2 Grf must be obtained within 14 working days of receipt of delivery. Returns will be accepted only in their original packaging, with any labels and accessories, in perfect condition for resale. they must not have been used or damaged.
13.3 If the above conditions are fulfilled, Lifestyle srl will reimburse the amount within 30 days. The customer has a legal obligation to take reasonable care of the items while they are in his possession. If the customer fail to comply with this obligation, his entitlement to a refund may be affected. The customer must also attach the return slip and receipt. in the event of a breach of the conditions set forth hereabove, Lifestyle srl may refuse the returns and not proceed with a reimbursement; returned damaged products, with no grf nor receipt will not be refund.
13.4 In this case, if the customer requests a reshipment of the products ordered, Lifestyle srl reserves the right to request the customer to pay the costs for reshipping. The return costs will be borne exclusively by the customer. If accepted, the reimbursement will be made within 30 days as of receipt of the products returned by Lifestyle srl in the same way as the order was paid.
13.5 To receive full refund based on purchase price of the item(s) and in the original form of payment:
The merchandise must be unworn, in sale-able condition with tags attached;
The merchandise must not be altered;
All merchandise must be returned within 14 days of the original purchase date;
Products may not be returned after 14 days.
13.6 Please note that also for exchanges, products will still need to be in unused, unworn, unaltered and undamaged condition. All returns must include original packaging: any boxes, dust bags, labels or other packaging materials.
ARTICLE 14. EXCEPTIONS
14.1 The right of withdrawal will not be accepted for products, which are made specifically or customized for the customer. If the customer finds any lack of conformity or a hidden defect in the products, he must immediately inform the seller.
14.2 Personalized or customized cannot be refunded.
ARTICLE 15. WARRANTY AND COMPLIANCE
15.1 The seller takes every care to ensure that the description and specifications of the products are correct at the time of purchase and delivery. The customer benefits from the legal compliance warranties from the date of delivery (shown on the transport document).
15.2 Lifestyle srl is protected under warranty for a period of 18 months from the original purchase date. The warranty covers materials and manufacturing defects.
15.3 In case of defect, the components will be repaired or replaced at our discretion, free of charge. please note that any evidence of tampering will void the warranty.
15.4 If the customer was to find any lack of conformity or a hidden defect in the products ordered, he must inform the seller by email at firstname.lastname@example.org. After expiration of the warranty, for repairs we will charge our customers an adequate amount.
ARTICLE 16. INTELLECTUAL PROPERTY RIGHTS
16.1 The Client acknowledges that he or she is aware that all trademarks, names and other distinctive signs as well as any names, images, photographs, written text or graphics used on the Site or relating to the Products are and remain the exclusive property of Lifestyle srl and/or its assignees, with no rights arising on the part of the Client in relation to the same as a result of access to the Site and/or purchase of the Products.
16.2 Unless prior specific consent is granted in writing by Lifestyle srl, no contents of the Site can be reproduced in whole or in part, transferred using electronic or conventional means, modified or used for any purpose whatsoever.
